COMPANIES AND INTELLECTUAL PROPERTY COMMISSION (“the CIPC”) COMPLIANCE CHECKLIST DISCLOSURE
MANDATORY AS FROM 1 JANUARY 2020
On 13 August 2019, the CIPC issued the public with Notice 52 of 2019 (“Notice 52”). In terms of Notice 52, the CIPC will be rolling out the Compliance Checklist (“the Checklist”).
WHAT DOES THIS MEAN?
Prior to the submission of all companies Annual Returns, the completion of the Checklist will be required. The Checklist entails the completion of 24 specified sections, resulting in all companies confirming their compliance status in relation to the Companies Act, Act 71 of 2008 (as amended) (“the Act”) and Companies Regulations 2011, (“Regulations”).
The CIPC will utilise the completed Checklist to monitor and regulate each company’s compliance with the Act and its Regulations. Should trends of non-compliance be noted, the CIPC may take applicable action.
